1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of the SIR CHARGE mobile EV recharging subscription service (“Service”) operated by SIR CHARGE (“we,” “us,” or “our”) via sir-charge.com and related applications.
By creating an account, subscribing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not subscribe or use the Service.
2. Service Description
SIR CHARGE provides on-demand mobile Level 3 (DC fast) EV charging delivered by specialized response vehicles. The Service is designed as an emergency or roadside battery boost and is not intended as a primary or regular replacement for home, workplace, or public charging infrastructure.
The Service is offered 24/7/365, subject to capacity, location, weather, and the limitations described in these Terms.
3. Subscription Fee
- Monthly subscription fee: $29.00 USD, billed automatically on a recurring monthly basis.
- Multi-year or prepaid plans (if offered) are available at the rates published at the time of purchase.
- We reserve the right to change pricing with at least 30 days’ prior notice to existing subscribers.
4. Included Subscription Benefits
Subject to these Terms and available capacity, active subscribers receive:
- 24/7/365 dispatch within the primary coverage zone.
- One complimentary mobile charge per qualifying request delivering approximately 25–50 miles of range, provided the vehicle reports ≤ 10% state of charge (SOC) at the time of the request and the vehicle is safely accessible and compatible with our charging equipment.
- Priority dispatch relative to non-subscribers when capacity allows.
5. Additional Charges
Additional fees may apply (quoted and approved before service begins when feasible) in the following situations:
- Battery level is above 10% SOC at the time of the request (convenience / non-emergency call).
- The vehicle is located significantly outside the primary coverage zone.
- Multiple vehicles, repeated calls in a short period, or extended on-site time caused by access issues or vehicle-side problems.
- Request for a charge larger than the standard complimentary 25–50 mile boost.
6. Service Limitations & Response Expectations
- We aim for reasonable response times but do not guarantee specific arrival times. Delays may result from traffic, weather, simultaneous calls, vehicle mechanical issues, or high demand.
- When multiple calls occur concurrently, we prioritize based on battery level, location, and safety risk. Lower-priority requests may experience longer wait times.
- If we determine the issue is not primarily a depleted battery (e.g., vehicle will not accept charge, major electrical fault, software lockout, damaged charge port, or other non-battery problem), we may decline service or apply a diagnostic/response fee. SIR CHARGE is not a towing or general roadside assistance provider.
- Power outages, extreme weather, road closures, natural disasters, or other force-majeure events may temporarily suspend or limit service.
- Service is limited to vehicles compatible with our equipment that can be safely charged at the reported location.
7. Coverage Zone
Primary coverage is currently focused on the metro Detroit / Oakland County area and surrounding regions actively serviced by SIR CHARGE. Requests significantly outside this zone may be declined or subject to additional travel fees.
The current coverage zone is published on sir-charge.com and may expand or contract over time.
8. Customer Responsibilities
You agree to:
- Provide accurate location, vehicle make/model/year, and current battery percentage.
- Ensure the vehicle is safely accessible (not blocked, on private property with proper permission, adequate space for a response vehicle and charging cable, etc.).
- Be present or designate an authorized person who can approve service and any applicable charges.
- Not request service if the vehicle is known to have a fault that prevents charging.
9. Cancellation, Refunds & Prepaid Subscriptions
9.1 30-Day Money-Back Guarantee
New subscribers may cancel and request a full refund of the subscription fee(s) paid within thirty (30) days of the original purchase date. After the 30-day period expires, no refunds will be issued for any reason, including but not limited to:
- Unused service
- Failure to use the Service
- Inability of SIR CHARGE to complete a specific charge request (vehicle incompatibility, site access issues, vehicle fault preventing charging, etc.)
- Dissatisfaction with response times or service quality
- Change of mind
9.2 Multi-Year / Prepaid Plans
If you purchase a multi-year or prepaid subscription (for example, 1-year, 2-year, or 3-year plans), the 30-day refund window still begins on the original purchase date. Once that 30-day period has passed, the entire prepaid amount is non-refundable, even if you never use the Service or if a later service call cannot be completed.
9.3 Service Attempts That Cannot Be Completed
If we dispatch to your location and determine that we cannot safely or successfully charge your vehicle, this does not create a right to a refund outside the 30-day window described above. In such cases we may, at our sole discretion, waive any additional service fees for that specific call, but the underlying subscription remains non-refundable after 30 days.
9.4 How to Request a Refund
Refund requests must be submitted in writing (email to support@sir-charge.com or through the account portal) within the 30-day period and must include your subscription details. Approved refunds will be processed to the original payment method within 10–14 business days.
9.5 Cancellation After 30 Days
You may cancel future billing at any time. Cancellation stops new charges but does not entitle you to any refund of amounts already paid.
10. Liability & Disclaimers
- The Service is provided “as is.” SIR CHARGE is not liable for vehicle damage arising from pre-existing conditions, software issues, manufacturer defects, or the vehicle’s inability to accept a charge.
- Our total liability for any claim related to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim.
- We are not responsible for consequential, incidental, or indirect damages, including missed appointments, subsequent towing, or lost time.
- You remain responsible for your vehicle’s condition and for complying with all applicable traffic and safety laws while awaiting service.
11. Additional Terms
- We may update these Terms from time to time. Continued use of the Service after notice of changes constitutes acceptance of the revised Terms.
- These Terms are governed by the laws of the State of Michigan. Any disputes shall be resolved in the state or federal courts located in Oakland County, Michigan.
- If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
- Failure by SIR CHARGE to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
